The notice specified that the dams were never permitted and were not up to code, which meant the associated lakes were out of compliance. The property owner at that time, West Virginia Economic Development Authority (WVEDA), was informed that failure of the lakes could pose a potential life-threatening situation to anyone traveling State Route 2. WVEDA was required to either bring the impoundments into compliance or drain the lakes as a potential life-saving measure. Upon purchasing the property from WVEDA in late 2022, BHE Renewables evaluated all options for Kera Lakes, including discussing the matter with other potential owners of the lakes and determined the safest course of action is to drain the remaining two lakes and recontour the basin back to its original condition of a free-flowing natural stream. The proposed removal plan calls for the impoundments to be slowly drained and fish safely captured and relocated to a nearby private pond. I’ve been on the site numerous times for deliveries.
