But you see he wasn't taken to court because according to DOJ rules (since thrown out by SCOTUS) he could not be criminally prosecuted as a sitting president. Individual #1, the unnamed co-conspirator should have had his day in court facing charges that the prosecution needed to prove against his assumed innocence.
