Harvey to hear NFL appeal of Deshaun Watson’s 6-game suspension https://www.nfl.com/news/nfl-commissioner-roger-goodell-designates-former-n-j-attorney-general-peter-c-ha "Mr. Harvey served as the Attorney General of New Jersey and is now a partner at the Paterson Belknap firm in New York," the league said Thursday in a statement. "He has also served as a federal prosecutor. He has deep expertise in criminal law, including domestic violence and sexual assault, and has advised the NFL and other professional leagues on the development and implementation of workplace policies, including the NFL's Personal Conduct Policy. Mr. Harvey has also served as the Commissioner's designee in other arbitrations." Harvey served as the New Jersey attorney general from 2003-2006.

Apparently, Goodell has decided to appoint someone else to hear one of the most controversial and highest-profile appeals in the history of the NFL. Florio speculated that perhaps Goodell might appoint Mary Jo White, former U.S. Attorney for the Southern District of New York, or Condoleezza Rice, the former U.S. Secretary of State and current director of the Hoover Institute at Stanford who recently became part of the Denver Broncos ownership group. Now that the NFL has appealed the suspension, Roger Goodell can decide who hears that appeal including deciding he is the person to do so. It has been known that the NFL has wanted at least a year suspension since the discipline hearing started. We also found out the two sides tried to settle before Robinson’s decision but couldn’t find common ground. During that settlement talk, the NFL wanted a 12-game suspension and a huge fine while Watson’s side was more open to a six to eight-game discpline. According to multiple reports, which started with Adam Schefter’s appearance on ‘Get Up’, the reason the NFL wants Watson out for at least 12 games is that they don’t want him playing in Houston this year: As it has seemed with the NFL in a variety of situations, public relations seems to be a primary motivator once again. Whether someone believes that Watson deserves a longer suspension or not, extending it for this reason is not about doing the right thing. With the appeal from the NFL in, the NFLPA has two days to respond before the appeal process begins. That process may not take too long before a new punishment is enacted. From there, Watson may choose to pursue a federal lawsuit ala Tom Brady. More uncertainty and, seemingly, more PR spin while Browns training camp carries on.

Ruling on Deshaun Watson was Never Going to be Satisfying https://www.si.com/nfl/browns/browns-maven-features/unsatisfying-deshaun-watson-ruling The only guarantee with a resolution to Deshaun Watson's investigation by the NFL is it would be unsatisfying, dispiriting. Coming up with an adequate punishment for a series of charges with little proof was an impossible needle to thread, but the league was once again exposed for how ill equipped they are to deal with violence and mistreatment of women, despite countless opportunities to form a policy. Sports leagues are never going to be an effective substitute for the criminal justice system and even though they are operating based on the preponderance of evidence as opposed to innocent until proven guilty, it was a system fraught with problems before Watson getting to the NFL was a consideration... ...Vague guidelines allow the league to protect its owners while being able to punish players inconsistently and often more harshly. In this case, it came back to haunt them. The same rules that enabled them to avoid any meaningful punishment for New England Patriots owner Robert Kraft, caught on camera soliciting prostitution in Florida, allowed Robinson to default to the same punishment for Watson as Ben Roethlisberger and Ezekiel Elliott despite 24 women accusing him of sexual assault and misconduct. The NFL has allowed Washington Commanders owner Daniel Snyder to operate almost with impunity despite accusations that have been piling up for a decade which includes sexual assault. Until the league is willing to put pen to paper on a real policy that outlines punishments for both players and owners, they will continue to get what they view as unsatisfying results in cases like Watson.
