I think you're pretending to misunderstand the change in the job description. Had it included issuing marriage licenses to homosexuals (or where a thong a burga or a swastika armband) when she got the job she would not be qualified for it. If you are ordered to do any of that after you get the job... As simple as that.

Not sure about Kentucky but in our neck of the woods each elected official files an oath of office. that oath, and I generalize, states that the person will uphold the laws of the United States, etc. If the person refused to resign and willingly refused to perform the duties they are required by law, then they would probably got to jail here.

Unfortunately it is true we just typically think of police officers, judges, district attorneys, etc. in a different light. Again not sure about Kentucky but in most states County, Town and City Clerks are state constitutional officers given the duty as clerk of the court and registrar of deeds. Their office hours, fees, etc. are set by state law and how they operate are governed by such. The issuance of the marriage license is a matter of law, not personal preference, the same as the recording of a deed. I am pretty certain that there are several NYS Sheriffs who do not want to enforce the provision of the NYS Safe Act that limits the amount of rounds in a magazine but they have to nonetheless.

She's using her government position to enforce her religious beliefs on the people she's supposed to be serving. If she doesn't want to do her job, she should quit. Oh that's right, she didn't break a law. There is no law in Kentucky pertaining to marriage as of right now. The Supreme Court has no authority to make laws. It's in the constitution that only congress and the states can do that. All the Supreme Court can do is offer an opinion on the constitutionality of existing laws. They gave the opinion that laws passed preventing gay marriage are unconstitutional and that's it. There are still no laws granting gay marriage.

Today, U.S. District Court Judge David Bunning ordered Rowan County, Kentucky, County Clerk Kim Davis to be taken into custody by federal marshals and to remain in jail until she agrees to issue licenses for same-sex "marriage" bearing her name. The plaintiffs did not even request incarceration, but Judge Bunning said that financial fines were not enough and ordered her to jail.

Everyone is stunned at this development. Kim Davis' First Amendment - protected religious liberties and right of conscience have been trampled under foot. Kim Davis is being treated as a criminal because she cannot violate her conscience.

Today's events will escalate the national debate to a new level. This is not the kind of America the Founders envisioned or that most Americans want.
