Acting AG, An Obama Holdover, Says Justice Dept Won’t Defend Refugee Order

This gal needs to be removed from office immediately:

 

Acting Attorney General Sally Yates, an Obama-appointee who is leading the U.S. Department of Justice (DOJ) until Sen. Jeff Sessions is confirmed, announced the department will not defend President Donald Trump’s executive order on refugees.

 

Yates ordered government lawyers not to defend challenges to the president’s order, which bans migration from seven countries with high instances of terrorism for a period of 90 days. The acting AG says she has an institutional responsibility to ensure that the department seeks and applies justice in an equitable way.

 

Her announcement is a stunning display of defiance that only finds precedent in the waning days of the Nixon administration, when the embattled president dismissed several senior DOJ employees who refused to comply with his orders to fire the special prosecutor leading the Watergate investigation.

and really, to all of us and our country.

 

The left doesn't care about our safety, the law... they are sick-minded to think

they are so exaulted globally, that they get to decide laws, they get to decide

who the pres is, they get to decide everything in the gov and for all of us.

But, they are traitors. Refusing to follow the oath of office is pretty frequent

in democratic circles these days.

 

The democratic party is now the enemy within. If they don't win, they won't let anyone else win.

Pretty dangerous situation - she had to be gone.

Statement on the Appointment of Dana Boente as Acting Attorney General

The acting Attorney General, Sally Yates, has betrayed the Department of Justice by refusing to enforce a legal order designed to protect the citizens of the United States. This order was approved as to form and legality by the Department of Justice Office of Legal Counsel.

Ms. Yates is an Obama Administration appointee who is weak on borders and very weak on illegal immigration.

It is time to get serious about protecting our country. Calling for tougher vetting for individuals travelling from seven dangerous places is not extreme. It is reasonable and necessary to protect our country.

Tonight, President Trump relieved Ms. Yates of her duties and subsequently named Dana Boente, U.S. Attorney for the Eastern District of Virginia, to serve as Acting Attorney General until Senator Jeff Sessions is finally confirmed by the Senate, where he is being wrongly held up by Democrat senators for strictly political reasons.

“I am honored to serve President Trump in this role until Senator Sessions is confirmed. I will defend and enforce the laws of our country to ensure that our people and our nation are protected,” said Dana Boente, Acting Attorney General.

We either are a nation of laws with a constitution that is followed or we become a banana republic. I was glad to see Trump take quick action against a disgraceful acting AG. The proper way to fight against laws you don't like or agree with is to work to change them legally.If I got cited for speeding going 90 on the interstate I doubt that I could use a legal defense in court that I don't like or agree with the 70 mph speed limit. I believe I would be told that 70 mph is the law and pay my fine with clerk.

 

The same thing applies with the illegal actions of leaders of sanctuary cities. What special right do they have to disobey federal law? None.

Yet the trump team still asked her to take over on a temporary basis until Sessions was confirmed.

 

Perhaps if the administration spent more time keeping governmental departments in the loop and vetted the people they placed in certain positions, the first two weeks would've gone much more smoothly.

One man's hero is another man's villain. I am not super familiar with that story, was she legally bound to issue the license?

 

I was listening to NPR about this and I learned this: As for the AG, her department actually has a something called a 'dissent channel' which is in place so that she can legally oppose a president's orders. The way it works is she communicates her dissent through the channel, it bubbles up to the president, and the president can then ask for her resignation.

 

The lawyer on the show said her position that the executive order is unconstitutional has merit and can be argued in court, but her mistake was that she didn't use the dissent channel to voice her position.

I understand the argument that an AG may not follow an executive order if it is illegal but this EO was approved already as to the legality of the order by the Justice Dept. So this AG didn't like the order and decided to not follow the order. That is not acceptable ever. She can disagree with the order but she is obligated to follow it.

I just saw that that is absolutely true on Fox News at the press conference.

 

Furthermore, it was reviewed, and went through a significant process and evaluation

before Trump signed it.

 

But the press... they kept asking about how Trump shouldn't have done it, why would the acting

ag be fired because she didn't want to ....blah blah blah blah.

 

And one woman "journalist" made a fool of herself doing the same thing. Gen Kelly

had to stand up and say what the truth was, and STILL she kept going on and on

about why Trump hadn't discussed with Kelly, well after Kelly said he was briefed

several times at length, consulted, etc etc etc.

Replacing Yates is Boente, who has served in various positions inside the Justice Department over more than 30 years, beginning in the Tax Division.


In 2001, he served as the assistand U.S. attorney in the fraud unit in the Eastern District of Virginia. In December 2012, Attorney General Eric Holder appointed him to serve as the chief federal prosecutor in the Eastern District of Louisiana. He held that position until September 2013, and Obama nominated him to be U.S. Attorney in Alexandria, Va. in 2015.
