I'm the first to admit the kid is a knucklehead who has made a lot of questionable decisions. But this whole process from start to finish reeks of incompetance and flat out questionable ethics from the NFL league office. I'd be absolutely incensed right now if I was the Browns organization over this whole fiasco. The precedent would be Kevin and Pat Williams (Vikings) - where the succesffuly got a temporary restraining order against the NFL that allowed them to play for 2 years...it would have prevented them from getting a suspension (they eventually did get suspended) because they tried to argue that the NFL could not ban substances that were not illegal by the state's law...Gordon's suit would be different in that it would argue that the NFL's limits to a drug can not be more stringent than the State's drug limits (if Gordon worked for Shewin Williams and got drug testes, the levels he tested postive for would not trigger a negative test) Link to comment Share on other sites More sharing options...

If his levels wouldn't trigger a positive in any kind of private company test or state/federal employee test....than why suspend him at all? They can't necessarily argue against the suspension, but only in the way it was handled. People have been asking for a decision for weeks and months now. There has to be a pretty compelling reason for them to have waited for this long other than well we were waiting to see if Johnny Manziel would be a day one starter. No one is denying the kid has made stupid decisions along the way, and no matter what one's personal opinion on marijuana is Gordon should have known to dodge the shit with a 100ft pole. But there's a lot of good precedent here that the NFL's system is fundamentally flawed, and this case was handled extremely innappropriately from the start till now. Ohio Labor Law says his test (if the reported "levels" are accurate) was negative b/c of a "below level" screen on the "B" bottle, but the NFL SA Policy says it's positive b/c of "any presence" of THC in the "B" Bottle. According to Federal Law, the Ohio Labor Law outweighs the NFL SA Policy... He could file for a Restraining Order, which would halt the suspension, while the legal process plays out... If that were the case, and he won, he would still face a possible suspension for the DUI; however, that is part of the Personal Conduct Policy and has nothing to do with the SA Policy, and that case was postponed until late November. Screw Ohio Labor law. The law should pertain to all players equally, across the NFL. I hate to see him gone, but fuck him. He was a dumb ass and now he payin. Never mind the most recent test(s), he should never have put himself in that position. He shouldn't have continued to associate with those who jeopardized his future. Hopefully, he will learn. The bigger problem, as I see it, is Roger Goodell. The Browns, thanks to his inept & inconsistent handling of this situation & others (ie the woman beater), may be the ones hurt most by his foot dragging. Regardless how much money he supposedly makes for the owners, he continues to compromise the integrity of this game & that will cost Fans. I just hope the Owners fire his ass before he drags this sport totally down. He preaches safety, yet Suh is allowed to stomp on & mug players & pay chump change for doing it. Meriweather sits 2 games for his SIXTH head to head hit. Before, it was mere fines. I say fine them AND suspend them a game for every game missed by someone they have injured with a cheap shot. And no, Roger, I do NOT want 18 games, nor do I want an NFL Team in Europe. This is AMERICAN football! The NFL belongs HERE! Roger talks one game & plays another. IMHO, he's a damn hypocrite! A guy passes 70 drug tests over the last year and one inconclusive test is enough for a year's banishment. It is ridiculous. I agree completely. I am the first to say he needs to make better decisions and change his crowd. This test "failure" however is ridiculous. It is hard for me to even believe the micro fraction by which he failed is within the repeatable tolerance of the test. In addition the length of time to hear the appeal and reach a decision was nothing short of negligent on the part of the NFL. They fucked the organization, the players personally and all the fans by dragging it out. Not only should Josh Gordon file an injection the team and fans should as well. Goodel is doing his damnsest to turn football into a pussy game in a militia rule environment.For those of you who believe Ohio labor law should or doesnt have anything to do with it thats ridiculous. It is his legal righg to appeal within the confines of the law that applies. Outside of this "failure" I would not ask for a second for special treatment for the DUI if he is convicted. Sean Payton and Greg Williams were rewarding guys for purposely hurting or maiming a player on the field. They encouraged it and rewarded it. Honestly Gordon and the rest of the players should be furious with their own union for agreeing to such a ridiculous set of test criteria in comparison with that of the Olympics, baseball and even the federal government.
