Pilot won't be prosecuted

Pilot Flying J said Monday it has “reached an understanding with the U. S. Attorney’s office” and the U. S. Department of Justice, that the company will not be prosecuted in connection with an ongoing criminal investigation into alleged diesel fuel rebate fraud.


According to a news release, the agreement assumes the company follows the terms of an agreement, including paying a $92 million monetary penalty over the next two years and fully cooperating with the federal government’s investigation of fraudulent conduct within the company’s diesel fuel sales discount programs.


“We, as a company, look forward to putting this whole unfortunate episode behind us, continuing our efforts to rectify the damage done, regaining our customers’ trust, and getting on with our business,” CEO Jimmy Haslam said in the release. “We’ve been committed from the beginning of this to doing the right thing, and that remains our commitment.”


According to a news release from the U.S. Attorney for Eastern Tennessee, the agreement “expressly states that it provides no protection from prosecution to any individual, and moreover, imposes a continuing obligation on Pilot to provide complete cooperation with the ongoing federal investigation of current and former Pilot employees relating to fraudulent conduct involving the sale of diesel fuel.”


The government’s investigation of alleged diesel fuel rebate fraud at Pilot became public last year. Since then, the company has reached an $85 million settlement in federal court with trucking customers who claimed in civil lawsuits that they had been shorted on diesel fuel rebates. Under that settlement, Pilot agreed to repay any amounts owed, plus 6 percent interest and attorneys’ fees.


A criminal investigation is ongoing, and 10 former employees have pleaded guilty to charges in connection with the case.


In a news release, U.S. Attorney Bill Killian said that “The terms of this agreement, including the significant monetary penalty and the very serious consequences if Pilot fails to comply, demonstrate quite clearly that no corporation, no matter how big, influential, or wealthy, is above the law. In addition, the company’s agreement to fully cooperate with the United States, including its obligation to identify its employees’ criminal conduct, will assist the ongoing federal investigation. The agreement ensures that Pilot’s extensive remediation efforts will continue until all trucking company victims have received full restitution and until Pilot has demonstrated to the United States that it has implemented sufficient internal controls to prevent this kind of fraudulent conduct from ever occurring again.”

I believe individuals can still be charged if found to be involved in wrong doing. How does this actually help? It was already known that some individuals were involved, so how can Haslam be considered safe?

Every individual in the company is fair game for prosecution still if found complicit. This simply negotiates a settlement for the overall company. It is pretty black and white in the way its written that neither Haslam or any other Pilot employee are safe.

So they are guilty... Just no jail time. Money gets you out of everything.

 

If you bothered to read the detials, there could be jail involved- it's just Pilot is making restitution in spades. So on the corporate level, Pilot is OK in the eyes of the Feds.

Carpetbagger owner, dishonest businessman.

Just like the Steelers founder, though he was probably more of a home grown dishonest businessman.

 

Nearly evey owner can be called a carpetbagger in that they are not natives of the town/region their team is located. Hell, we had a non-carpetbagger owner, a Cleveland native owner called Randy Lerner. I will try my luck now with this carpetbagger.

I mean the guy that is just as beloved as Art Rooney was....Ralph Wilson, was a carpetbagger from Detroit.

Then there was Art Modell....the biggest carpetbagger of them all.

There are the DeBartolo/Yorks. Last time I looked their NFL team did not play in Youngstown.

I suspect that if you went down the list of all 31 majority owners of NFL teams, 75% of them could be considered "carpetbaggers".

Carpetbagger - never heard the term before. Lest we forget, though, this particular carpetbagger was also a carpetbagger part-owner of the Steelers.

Really? You mean you have never heard of the term at all, or have never heard it in terms of sports ownership.

OK, well, a large majority over here...including most Cleveland Cavalier fans would not know the connotation in the term "roundhead".

Sure, and they'd have no reason to, I wouldn't hold it against them.

 

Saying that, if you're a fan of a 'roundhead' team, you should probably know cavalier. But cavalier is such a widespread term in medieval times that it's not tied down to roundheads vs cavaliers.

Yes... Pilot is the only "person" cleared so far...
